Dutch regulators accuse Microsoft of violating Windows10 user privacy

The Dutch privacy watchdog, Autoriteit Persoonsgegevens, accused Microsoft of Windows 10 violating data protection laws and collecting data from users' computers without clearly communicating the specific content and purpose they send to their servers. The Dutch Data Protection Agency (DPA) concluded that when using the default settings, Microsoft continues to collect usage and information about applications and web surfing, and added that Microsoft has enabled full telemetry settings by default when users install Windows 10.

In addition, the organization claims that not only does Microsoft require users to accept the provided settings, but the Windows 10 installer also offers the option of using telemetry data and displays personalized advertisements and recommendations in Windows and Edge by default. If the user does not actively change the default settings during the installation process, this does not mean that the user therefore agrees that Microsoft uses the user's personal data.

The Dutch DPA also accused Microsoft of ignoring the user's privacy settings when upgrading to creator updates because computers previously set up as basic telemetry automatically switched to full telemetry levels without user changes. Dutch officials claim that the amount of data that Microsoft collects from users' computers allows the company to stay focused on what Windows 10 customers do on their computers.
